Hill's Science Diet Puppy and Kitten Photobook Promotion
How to Claim
To be eligible to claim a personalised Hill's Pet Photobook, individuals must register as a user on the Hill's Science Diet Pet Parenting Academy website by visiting sciencedietppa.com.au, following the prompts to the registration page, inputting the requested details including their pet's name, pet's birth month, pet's gender and pet's breed and their own full name, valid email address and postal address and submitting the fully completed registration form between 01/10/11 and 11.59pm AEDST on 02/03/12. Claimants may only include the details of one (1) of their pets on the registration form.
Claimants can then continually upload photos of their pet onto their profile page on the Hill's Science Diet Pet Parenting Academy website after they register, which will be added to their personalised Hill's Pet Photobook. Photos must be uploaded by 31/07/12 to appear in a claimant's personalised Hill's Pet Photobook.
Terms and conditions
Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
Claims are only open to Australian and New Zealand residents.
Claimants under 18 years old must have parental/guardian approval to claim and further, the parent/guardian of the claimant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this offer.
The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant's identity, age and place of residence) and to disqualify any claimant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable claims will be deemed invalid.
Only one claim permitted per person.
If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
Offer commences on 01/10/11. Registrations close 11.59pm AEDST on 02/03/12. Claimants must upload photos onto their profile page on the Hill's Science Diet Pet Parenting Academy website by 31/07/12.
Claimants will be notified at the end of the offer period via email when their gift will be sent to them. Gift will be sent to the claimant's postal address, as provided on the registration form. The gift will be sent out to claimants between 01/08/12 and 30/09/12.
The Promoter's decision regarding all elements of this offer is final and no correspondence will be entered into.
Every valid claim received will be awarded a personalised Hill's Pet Photobook valued at $15.34. The Photobook will contain photos that the claimant has uploaded onto their profile page between the date they registered and 31/07/12. The final layout of the Photobook will be determined by the Promoter in its absolute discretion.
The gift is not transferable or exchangeable and cannot be taken as cash.
If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
Any cost associated with accessing the Hill's Science Diet Pet Parenting Academy website is the claimant's responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the gift.
When a claimant submits any materials via the offer including images ("Content"), the claimant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Claimants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Claimants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Claimants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the claimant indemnifies the Promoter for any breach of the above terms.
The personalized Photobook produced by the Promoter on behalf of the claimant is and will always remain the intellectual property of the Promoter, excluding the claimant's Content incorporated into the Photobook which is used under license as provided above. Claimants have no other intellectual property rights in relation to the personalized Photobook other than those provided under these Terms and Conditions.
Further, unless otherwise indicated and with the exception of claimant Content as appropriate, all copyright in the information and materials contained in the Photobook (including but not limited to any text, images or other material), together with any trade mark/s, logo/s and/or any other material in which intellectual property right/s are capable of subsisting, as featured herein, is owned by the Promoter, or otherwise reproduced by it with the permission from the relevant owner/licensee, as the case may be. The Photobook (or any portions thereof) may not be reproduced (other than solely for personal non-commercial home use), or adapted, modified, duplicated, copied, sold or otherwise exploited for any commercial purpose without the prior written consent of the Promoter.
The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
